Our Privacy Policy

We are committed to ensuring your privacy is protected. If you have any requests concerning your personal information or any queries with regard to these practices please contact us at info@mcsuk.org

Please note that all data thus captured will be used and held in accordance with the requirements of the Data Protection Act 1998.

Information gathered

We collect information from visitors to this website through the use of online forms e.g. when you register for an event, sign-up to receive something, or become a member.  We also collect information about the transactions you undertake through this site, including details of payment cards used. We collect additional information automatically about your visit to our website - please see our use of cookies section below for more details.

What we do with this information

We process personal information collected via this website for the purposes of:

  • Providing and personalising our services

  • Providing you with information about our conservation activities

  • Dealing with your enquiries and requests

  • Administering orders

  • Internal record keeping

  • Administering membership subscriptions

Marketing & Communications

We may like to contact you via email, SMS, telephone or post about our conservation activities, campaigns and appeals, new products, special offers, market research or other information which we think you may find interesting using the contact details which you have provided.

By entering into an agreement with us when you have joined as a member, made a donation, completed an order form, registration form or any other data capture form, you agree to this use of your data, unless stated otherwise.

By ticking a box on any data capture form to say you would like to 'receive information and offers from other carefully selected conservation partners in the future' you agree to us, from time to time, passing your information to other carefully selected and relevant conservation organisations that offer products, services or information that we have identified as likely to be of interest to you, and you opt in to contact via email, telephone, post and SMS. NB. Third Party data sharing is not something that MCS is actively doing at present, however it is something that we may do in the future, so we have put in place this option to ensure that when we do so, people who would like to be included can be.

Subject access requests

You have the right to see what personal data we hold about you.  To obtain a copy of the personal information we hold about you, for a small administration fee of  £10, please write to us at Marine Conservation Society, Over Ross House, Ross Park, Ross-on-Wye, Herefordshire, HR9 7QQ.

Our Use of Cookies

A "cookie" is a small text file that is placed on a user's computer hard drive by a website.

MCS uses cookies within its websites to keep track of information needed by a user as they travel from page to page, and also to gather information that will enable us to improve the way we structure our websites and provide you with the information you need.

MCS also uses tracking technology in its email communications to personalise the email and track whether the mail has been opened or read and whether the recipient has used any website links contained in the email communication. This allows us to monitor and improve our email communications and website. If at any point you wish to disable this technology, simply disable images in emails from MCS. You can also unsubscribe from our emails at any time using the link at the bottom of any e-communication.

Internet browsers normally accept cookies by default; however, it is possible to set a browser to reject cookies. If this is done it is important not to exclude the benign and useful session cookies. Choose an option that rejects all third party cookies. 

MCS also uses technology that uses Internet Protocol (IP) information exchanges during the course of normal web activity combined with data-enhancement technology to get detailed analytics information. This detailed analytics information enables the MCS to identify which organisations (rather than individuals) have visited our website, when they visited the website, what they searched on and the pages visited.

This page (together with the documents referred to on it) tells you the terms of use on which you may make use of our website (our site). Use of our site includes accessing, browsing or registering to use our site. Please read these terms of use carefully before you start to use the site. www.mcsuk.org is a site operated by the Marine Conservation Society (“We”).  We are a charity registered in England and Wales under company number 1004005 and in Scotland under company number SC037480 and have our registered office and trading address at Over Ross House, Ross Park, Ross-on-Wye, Herefordshire, HR9 7QQ. Our VAT number is 489 1505 17. We are a company limited by guarantee registered in England and Wales with company number 2550966.

Accessing our site

We do not guarantee that our site, or any content on it, will always be available or uninterrupted. Access to our site is permitted on a temporary basis. We may suspend, withdraw, discontinue or change all or any part of our site without notice. We will not be liable to you if for any reason our site is unavailable at any time or for any period.

You are responsible for making all arrangements necessary for you to have access to our site.  You are also responsible for ensuring that all persons who access our site through your internet connection are aware of these terms, and that they comply with them. 

Our site changes regularly

We aim to update our site regularly, and may change the content at any time. If the need arises, we may suspend access to our site, or close it indefinitely. Any of the material on our site may be out of date at any given time, and we are under no obligation to update such material.

We are the owner or the licensee of all intellectual property rights in our site, and in the material published on it.  Those works are protected by copyright laws and treaties around the world. We are also the owner of the trade mark (“TRADE MARK 1”, the MCS logo), which is a UK registered trade mark, and also of the various other unregistered trade marks which we use on our site.

Viruses, hacking and other offences

You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack.

By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.

We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our site or to your downloading of any material posted on it, or on any website linked to it.

The operators of these sites may collect information from you that will be used by them in accordance with their privacy policies, which may differ from ours.

Jurisdiction and applicable law

The English courts will have exclusive jurisdiction over any claim arising from, or related to, a visit to our site, although we retain the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country. 

These terms of use and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.

Terms & Conditions of Supply


Delivery times

MCS aims to despatch any purchase within 5 working days of receipt of an order Monday to Friday (UK times). However, to cater for all eventualities please allow 28 days for delivery. Credit and debit cards will be charged by MCS and card details will not be passed to any third party.

Your commitment to MCS

The majority of people who donate to MCS, become members or adopters or purchase items from our shop, do so in order to support the work that MCS is engaged in. It is your responsibility to ensure that any account from which you are making payments to MCS has sufficient funds to cover your support. MCS will not be liable for any bank (or similar) charges incurred due to any failure to ensure adequate monies are maintained in your account.

Order processing

You confirm that all the details provided are correct - MCS cannot be held responsible for errors in information provided by the customer. If your online order or donation is accepted, we will send you an email confirming acceptance of your order. Please note it is your responsibility to ensure that you have ordered what you intended. If you receive more than one confirmation email, MCS would urge you to check to ensure that you have not placed more orders than you originally intended. MCS will not presume that repeat orders are a mistake, but will act on all orders received unless notified otherwise within the five days of receiving the order or until such time as the contract has begun.

Your right to cancel

Pursuant to The Consumer Protection (Distance Selling) Regulations 2000 (hereafter referred to as the Regulation) regulation 13( 1 )(a) the contract to supply your membership, adoption or shop merchandise will begin as soon as payment has been received from yourself, or as soon as MCS has despatched the merchandise further to a confirmed order from yourself, whichever is the sooner. In the terms of the Regulation the adoption pack is considered to be goods personalised to the consumer's specifications. This means that, with the exception of the conditions detailed under Refunds and Exchange, you will not have the right to cancel once the contract has begun.

Cancellation

Pursuant to the above paragraph and The Consumer Protection (Distance Selling) Regulations 2000 a notice of cancellation will be accepted if you:
(a) leave your notification at the address last known to you and addressed to the supplier or other person by name (in which case it is to be taken to have been given on the day on which it was left);
(b) send it by post to the address last known to yourself and addressed to the supplier or other person by name (in which case, it is to be taken to have been given on the day on which it was posted). Please post to the address below under Refunds and exchange;
(c) send it by facsimile to the business facsimile number last known to you (in which case it is to be taken to have been given on the day on which it is sent). Please fax to 01989 567815; or
(d) send it by email, to the business email address last known to you (in which case it is to be taken to have been given on the day on which itis sent). Please email info@mcsuk.org.

If payment has been taken when you choose to attempt to cancel then our refunds policy, as detailed below, applies.

Refunds and exchange

If the adoption pack or shop merchandise you receive is damaged, or not as you specified in your original order, we will replace it or give you a full refund. Please email info@mcsuk.org., call 01989 566017 for help in processing your request before sending anything back to MCS.

Use of the Good Beach Guide
 

All information contained in the Good Beach Guide is published by the Marine Conservation Society. Any individual acting upon information contained in this Guide does so entirely at their own risk. MCS does not accept any responsibility for any individual visiting or bathing at beaches listed in the Good Beach Guide. All information supplied by third parties to MCS for publication in the Good Beach Guide is solely the responsibility of those parties. Information relating to personal safety and risk is assessed by the appropriate authority and/or statutory governing body for the public and beach owners to act on accordingly. MCS has no input to information relating to personal safety or risk assessments, nor do we review its appropriateness. The symbols depicting the water quality of all beaches refer to 2008 water quality only, and apply to normal bathing conditions. Bathers swim entirely at their own risk.

Fundraising dinner early bird offer

The Early Bird booking offer is open to individuals booking their tickets online for the Cyrus Todiwala and Tony Singh MCS Fundraising Dinner on 2nd April 2014. The offer is restricted to the first 20 bookings made from 5.00pm 13th January 2014 to 5.00pm 14th February 2014. The offer is restricted to one copy of the book per booking made.
